Acceptance of Terms
By accessing or using EvacPlan (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are using EvacPlan on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
If you do not agree to these Terms, you must not use the Service. These Terms apply to all users of EvacPlan, including trial users, paying subscribers, wardens, and fire service viewers.
These Terms should be read alongside our Privacy Policy, which explains how we collect and use personal data. Both documents form the agreement between you and Ommateum Ltd.
The Service
EvacPlan is a cloud-based evacuation management platform provided by Ommateum Ltd (Company No. 16805861), 16 Antona Drive, Raunds, Northamptonshire, NN9 6DZ ("we", "us", "our").
The Service enables building managers, housing associations, care providers, and fire safety professionals to:
- Create and manage Personal Emergency Evacuation Plans (PEEPs)
- Upload and display floor plans with evacuation overlays
- Manage Fire Zone Charts and General Emergency Evacuation Plans (GEEPs)
- Share evacuation data with wardens and fire services
- Generate reports for fire authority submission
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with reasonable notice where possible. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.
Accounts & Access
Registration
To use EvacPlan, you must register for an account. You agree to provide accurate, complete, and current information during registration and to keep this information up to date.
Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at hello@evacplan.co.uk if you suspect any unauthorised access to your account.
User Roles
EvacPlan operates a role-based access control system. The account owner (Manager) is responsible for ensuring that access is granted only to appropriate individuals within their organisation, and that role assignments are kept up to date when staff change.
Trial Accounts
New accounts receive a 30-day free trial. At the end of the trial period, access will be restricted unless a subscription is taken out. Trial data is retained for 33 days after trial expiry, after which it may be permanently deleted.
Subscriptions & Payment
EvacPlan is available on the following subscription plans:

Pricing is agreed directly with Ommateum Ltd. Invoices are issued by Ommateum Ltd and are payable within 30 days of issue. We reserve the right to suspend access for accounts with overdue payments after reasonable notice.
Cancellation: You may cancel your subscription at any time by contacting us at hello@evacplan.co.uk. Cancellation takes effect at the end of the current billing period. We do not offer pro-rata refunds for partial periods.
Acceptable Use
You agree to use EvacPlan only for lawful purposes and in a manner consistent with these Terms. You must not:
- Use the Service for any unlawful purpose or in violation of any applicable regulations
- Upload false, misleading, or fabricated resident or PEEP data
- Attempt to gain unauthorised access to any part of the Service or another user's account
- Reverse engineer, decompile, or attempt to extract source code from the Service
- Use the Service to store or transmit malicious code
- Resell or sublicense access to the Service without our written consent
- Use the Service in any way that could damage, disable, or impair it
- Scrape, crawl, or harvest data from the Service by automated means
Compliance with Fire Safety Legislation
You are responsible for ensuring that your use of EvacPlan complies with all applicable fire safety legislation, including the Fire Safety Order 2005, the Fire Safety Act 2021, the Building Safety Act 2022, and the Fire Safety (Residential Evacuation Plans) (England) Regulations 2025. EvacPlan is a tool to assist compliance — it does not guarantee compliance, and you remain responsible for the accuracy and adequacy of your evacuation plans.
Data & Privacy
Your Data
You retain ownership of all data you upload to or create within EvacPlan ("Customer Data"), including resident information, floor plans, and PEEP records. You grant us a limited licence to store, process, and display this data solely for the purpose of providing the Service to you.
Data Processing
Where you upload personal data about residents, you are the data controller and we act as your data processor. We will process such data only in accordance with your instructions and our Privacy Policy.
Your Responsibilities
As a data controller, you are responsible for:
- Obtaining all necessary consents from residents before entering their data into EvacPlan
- Providing residents with appropriate privacy notices
- Ensuring the accuracy of data entered into the platform
- Complying with UK GDPR and the Data Protection Act 2018
- Responding to data subject access requests relating to resident data
Data Export & Portability
You may export your data at any time using the report generation features within EvacPlan. On request, we will provide a full data export in a commonly used format within 30 days of your account closure.
Intellectual Property
The EvacPlan platform, including its design, code, features, and documentation, is owned by Ommateum Ltd and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.
You retain all intellectual property rights in your Customer Data and the floor plans you upload. By uploading floor plans created by Ommateum Ltd as part of a surveying engagement, you acknowledge that those plans remain the intellectual property of Ommateum Ltd and are licensed to you for use within EvacPlan.
The EvacPlan name, logo, and branding are trademarks of Ommateum Ltd. You may not use our trademarks without our prior written consent.
Limitation of Liability
Disclaimer of Warranties
EvacPlan is provided "as is" and "as available". We make no warranties, express or implied, regarding the Service, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses.
Limitation
To the maximum extent permitted by law, Ommateum Ltd's total liability to you for any claims arising out of or relating to these Terms or your use of the Service shall not exceed the total fees paid by you to us in the 12 months preceding the claim.
We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of your use of or inability to use the Service.
Important: EvacPlan is a tool to assist evacuation planning. We are not liable for any loss of life, personal injury, or property damage arising from a failure of evacuation procedures, inaccurate PEEP records, or any failure to comply with fire safety legislation. Responsibility for the safety of building occupants remains with the responsible person under the Fire Safety Order 2005.
Indemnification
You agree to indemnify and hold harmless Ommateum Ltd from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your breach of these Terms, or your violation of any applicable law or third-party rights.
Termination
Either party may terminate the agreement at any time:
- You may cancel your subscription at any time by contacting hello@evacplan.co.uk
- We may suspend or terminate your account immediately if you breach these Terms, fail to pay invoices after reasonable notice, or if we have reason to believe your account poses a security risk
On termination, your access to the Service will cease. We will retain your data for 30 days following termination to allow export, after which it will be permanently deleted in accordance with our Privacy Policy.
Sections 6, 7, 8, and 11 of these Terms survive termination.
Changes to These Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email at least 30 days before the changes take effect. Your continued use of the Service after that date constitutes your acceptance of the updated Terms.
If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription in accordance with Section 4.
Governing Law & Disputes
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
We are committed to resolving disputes fairly and promptly. If you have a complaint, please contact us at hello@evacplan.co.uk in the first instance and we will endeavour to resolve it within 10 working days.
